Acceptance of Terms

By engaging our services, you agree to be bound by these Terms of Service, which govern all agreements between you ("Client", "you") and DreamCanyon ("we", "us", "our"). These terms apply to all services provided, including web design, hosting, management, and related digital services.

The quote, proposal, and/or project agreement accompanying this document outlines the specific scope of work we have agreed to perform for you, our cost estimate, project timeline, and any specific terms related to the project.

We may update our terms of service from time to time, however any changes will most likely be subtle. The most current version will always be available at https://dreamcanyon.co.uk/terms-of-service. The updated terms of service become effective immediately as soon as they are published on our website. The Continued use of our services after an update indicates acceptance of the revised terms.


Services Provided

We offer:

  • Website design and development
  • Website hosting
  • Website management (on-going support & maintenance)

Fees & Payment Terms

A 50% deposit is required before any work begins, unless otherwise agreed in writing. The remaining balance is due upon project completion and must be paid prior to website launch or transfer. A detailed payment schedule will be included in your project proposal and/or project agreement.

Our invoices are due within 14 days of issuance, unless otherwise agreed. Late payments may result in project delays, suspension of services, or cessation of work. While rate adjustments are rare, we will notify you in advance of any changes prior to starting a new scope of work.

Any services or revisions requested beyond the agreed scope will incur additional charges, billed either at our standard hourly rate or as a separate fixed fee.

Ongoing website hosting & management fees will be billed on a recurring basis in line with your scheduled billing date. These charges are non-refundable.

All deposits are non-refundable.


Early Termination of Website Project

Either party may terminate this agreement by providing 14 days' written notice.

If you choose to terminate the project after work has begun, you will remain liable for 100% of the final project cost as outlined in your proposal and/or project agreement. Any reduction to this amount will be at our sole discretion.

We reserve the right to terminate this agreement with written notice if:

  • Invoices are not paid by their due date
  • Required materials or feedback are not provided within a reasonable timeframe
  • Clear instructions are not given to enable us to carry out the work.

Cancellation of Web Hosting & Management

You may cancel web hosting & management by emailing hello@dreamcanyon.co.uk at any time with 30 days' notice.

Cancellation does not entitle you to a refund for any prepaid or unused fees. To cancel services, you must notify us via email. Until we receive your written cancellation, billing will continue, and you will remain liable for all associated fees and services.

Once cancelled, web hosting & management services may only be reinstated at our discretion and will be subject to our current pricing. Web hosting & management is intended as an ongoing service and cannot be paused or activated solely during months when work is required.

If your website is hosted on our servers and you choose to cancel, we will provide you with the website files upon request. However, we are not responsible for transferring the site to a new hosting provider. Access to or transfer of website files will only be granted once all outstanding invoices have been settled.


Website Design & Development

We will provide initial design concepts that reflect the goals, branding, layout, and functionality discussed for your project. Designs may be refined and adjusted based on your feedback, within the scope of the agreed timeline and budget specified in your proposal and/or project agreement.

As beauty in design lies in the eye of the beholder, it's important that you communicate any concerns or expectations clearly during the design phase. Constructive feedback and timely communication are essential to ensure the outcome aligns with your vision. If, after reasonable revisions, you choose to terminate the project, you will remain liable for 100% of the final project cost.

Before development begins, we require written confirmation that the design is approved. This approval acts as a sign-off and indicates that no further design revisions will be made. It is your responsibility to ensure all relevant stakeholders have reviewed and approved the final design. Any changes requested after final design approval will be billed separately at our standard hourly rate.

The project will be considered complete on the agreed launch date. Final payment is due before launching your website. Any further updates, maintenance, or ongoing support beyond this point will be determined by the terms of the hosting and management agreement/plan you have chosen (if applicable).

Scope

The cost of your project is based on the features and tasks specified in your proposal and/or project agreement. Any functionality or requirements not explicitly listed should not be assumed to be included. Additional revisions or major scope changes may require a revised quote.

Content (Copywriting & Media)

You are responsible for providing us with all content needed to successfully complete the project in a timely manner (this includes text, images, videos, documents, etc.). If there are delays in receiving content or materials from you, we cannot be held responsible for any missed deadlines. In such cases, we reserve the right to revise the project timeline and provide an updated quote to account for the additional time required to complete the work.

We are not responsible for producing any text copy unless this service was explicitly included in the proposal and/or project agreement.

External Modifications

We are not liable for any issues that arise from modifications made to the original codebase by you or any third-party developers. This includes, but is not limited to, edits to themes or templates, plugin installations, custom scripts, or direct modifications to the site's files or database. If you request our assistance to resolve problems caused by such changes, this work will be billed at our standard hourly rate.

SEO

We implement SEO best practices as part of our website builds, including clean site structure, crawlable content, and the use of appropriate HTML markup to support search engine indexing. However, we do not guarantee specific outcomes such as website traffic, user engagement, sales conversions, or ranking positions on Google or other search engines.

Please be aware that search engine algorithms are dynamic and beyond our control and thus we cannot guarantee specific search rankings or results.

Browser & Device Compatibility

We test your website across the most common browsers on Mac, PC, and mobile devices including Safari, Firefox, Chrome, and Edge. By default, we support the two most recent versions of each browser. Testing in older, unsupported, or beta versions is not included unless specifically requested and quotes for separately in your proposal and/or project agreement.


Web Hosting & Management

You can host your site with us and receive management services included, or you can host with a third-party service. If your website is not hosted with us, it is your responsibility to ensure that a suitable hosting service is in place, along with the necessary access credentials for us to complete your project. We're happy to assist you in locating a hosting service that suits your company.

Hosting Provided by us:

We offer website hosting through our servers through a basic or premium plan. We aim to deliver high performance and maintain a 99.9% uptime where possible. While we do our best to minimise disruptions, we cannot guarantee uninterrupted service or specific timeframes for resolving outages, whether scheduled or unexpected.

To ensure the stability and security of our hosting environment, we do not provide administrative access (such as FTP, SSH, cPanel, etc.) to third-party individuals or agencies.

Please note that certain website types may not be supported on our shared hosting – for example, sites involving adult content or sensitive medical information.

External Hosting:

If you prefer to host your website on your own server or through a third-party provider, we are happy to accommodate this. However, we are not responsible for issues with up-time, backups, performance, or technical support.

Updates, backups, and security management are your responsibility unless you choose one of our management plans. It's possible to keep your hosting with a different provider and have management done by DreamCanyon.

Management

Our hosting packages come with monthly website maintenance to help keep your site secure, stable, and running smoothly. Depending on the plan you select, our management services may include the following:

  • Content Updates (Premium only) – up to 1 hour of monthly content updates – text, images, blog posts/articles, updating contact details, etc.
  • Priority Support (Premium only) – Access to help for questions, technical support, and training on how to use your website tools.
  • Website Hosting & SSL Certificate – Reliable, fast website hosting with secure HTTPS encryption (SSL).
  • Software Updates – We keep your website platform up-to-date to ensure security, compatibility, and smooth performance.
  • Website Backups – Automatic backups taken regularly (daily or weekly) so your site can be quickly restored if anything ever goes wrong.
  • Email Configuration – Ensures your site's contact forms and other email functions work reliably by setting up a proper email sending method.
  • 24/7 Uptime Monitoring = Your website is checked around the clock to ensure it is online.
  • Domain Management – We assist with domain transfers, monitor expiration dates, and manage DNS settings.
  • DNS Management – We handle all the technical setup behind your domain—making sure your website, email, and other services are correctly connected and working smoothly.

Content Updates

We offer content updates as part of your plan, limited to adjustments that fit within the original scope of your website. This includes tasks like updating text, swapping out images, or modifying basic business information.

Requests that involve adding new pages, advanced features, or significantly altering the site's structure or design fall outside of routine updates. These types of changes may require a more extensive upgrade. If you're looking to expand or evolve your website, we'll be happy to provide a separate quote for the additional work.

Domain & DNS Management

If your domain is not under our management, you are solely responsible for maintaining its DNS settings and ensuring timely renewal to prevent service disruption.

Website Backups

As part of your hosting and maintenance plan, we regularly create full backups of your website and database. These backups capture the website at specific points in time and are securely stored to allow for restoration in case of technical errors, security issues, or data loss. Backup frequency is tailored to your site's activity level, content update frequency, and any custom arrangements we've made.

Please note that backups restore the site to its most recent saved state. Any edits or updates made after the last backup will be lost and must be reapplied manually. Backups are not a guarantee of zero data loss but are intended as a safety net for restoring website functionality.

Keep in mind, backups can only restore what existed at the time they were created. If the site was already compromised (e.g., infected with malware) before our first backup, we won't be able to revert it to a clean version prior to that point. We are not responsible for any lost data, content, or functionality caused by such issues.

Software Updates

We routinely maintain your website's core system, along with its themes and plugins, to keep everything up to date with the latest features, bug fixes, and security patches. This helps reduce the risk of compatibility issues and vulnerabilities.

24/7 Uptime Monitoring

We actively monitor your website 24/7 to detect downtime or availability issues. If a problem arises, we'll take prompt action to investigate and resolve it where possible. If the issue is found to be caused by changes made by you or a third party, our time spent on resolution will be billed at our standard hourly rate.

Security

We take all reasonable steps to deliver a secure website, but due to the nature of the internet and evolving technologies – it means we cannot guarantee that the system will be immune to security threats or breaches.

If your website becomes compromised, we will attempt to restore it to its most recent stable version—typically using available server backups. During the restoration process, we may be able to identify the likely cause of the breach. Any work required to fix vulnerabilities will be treated as a separate update and billed accordingly, unless you are covered under a web hosting & management plan with us.

Please not that this service does not include forensic analysis or in-depth investigation of the breach.


All content on www.dreamcanyon.co.uk is the intellectual property of DreamCanyon. You are permitted to access and view the website and its content for personal use only.

Unless explicitly authorised in writing, you may not:

  • Copy, reproduce, or republish any part of our content in any format
  • Use our material for commercial gain through sale, licensing, or rental
  • Share or distribute our content through any platform or channel
  • Download, print, or extract material for business or public use

For any website project, you confirm that all materials you provide — including but not limited to text, images, graphics, designs, and trademarks — are either owned by you or that you have secured the appropriate rights or licenses to use them.

Upon receipt of final payment, you are granted a non-exclusive license to use the website code (HTML, CSS, JavaScript, etc.) developed for your project. DreamCanyon retains ownership of all custom code, including but not limited to templates, plugins, and scripts, and reserves the right to reuse, modify, or license such code for other clients or projects. You also own the website files, design, graphics, and other visual elements that we create for you for this project. Please let us know if you would like a copy for your records.

Any third-party assets (e.g., fonts, stock images, or software libraries) remain subject to their original licensing terms.

Unless otherwise agreed in writing, we reserve the right to feature your project in our portfolio or marketing materials.

We reserve the right to include a small, discreet link in the footer of your website, acknowledging DreamCanyon as the designer. This helps us acknowledge our work and maintain a visible connection to the projects we create.


Data Protection & Privacy

We comply with all relevant data protection laws, including the UK GDPR and applicable U.S. privacy regulations (e.g., CCPA where applicable). We do not share or sell client data.


Liability

Although every effort is made to ensure your website and its features function smoothly, we do not guarantee that the website, templates, or any of its components will be completely and always free of errors. Accordingly, we are not responsible for any direct or indirect losses—such as loss of revenue, business interruption, or other incidental or consequential damages—that may result from the use of, or issues with, the website or any associated web pages.
